Trademark Registration in Nepal

Trademark registration in Nepal is one of the most important steps for protecting your business identity. Whether you are starting a new business or growing an existing one, your brand name, logo, or tagline represents your reputation in the market. Without proper legal protection, anyone can copy or misuse your brand, which can directly harm your business. In Nepal, trademark registration is governed by the Patent, Design and Trademark Act, 1965 (PDTA) and is handled by the Department of Industry (DOI). Once registered, your trademark becomes your legal property, giving you exclusive rights to use it in your business activities.

Why Trademark Registration is Important

Many businesses underestimate the importance of trademark registration, especially in the early stages. However, this can create serious problems later as your business grows.

If your brand is not registered, someone else can legally register a similar or even identical mark, and you may lose the right to use your own brand name.

Trademark registration provides:

Legal Ownership

Once registered, you become the official legal owner of the trademark. This ensures that no other business can use or claim your brand identity.

Protection Against Misuse

If someone copies or imitates your trademark, you have the legal authority to take action against them, including filing complaints or claiming damages.

Brand Trust and Credibility

A registered trademark builds confidence among customers, partners, and investors. It shows that your business is legitimate and professionally managed.

Increased Business Value

A trademark is an intangible asset. As your business grows, the value of your brand increases, which can be beneficial for expansion, partnerships, or investment opportunities.

Competitive Advantage

A protected brand helps you stand out in the market and prevents competitors from using similar branding.

Actual Trademark Registration Process

Understanding each stage of the process helps you avoid confusion and prepares you for what to expect.

\

The process begins with a detailed discussion about your business and the trademark you want to register. This could be your business name, logo, slogan, or a combination of these elements.

After understanding your requirement, a trademark search is conducted in the Department of Industry database. This step is crucial because it identifies whether:

  • Your trademark is already registered

  • A similar trademark exists

  • Your trademark may create confusion in the market

Skipping this step can lead to rejection later, wasting both time and money. A proper search significantly increases the chances of successful registration.

Every trademark must be registered under a specific category known as a “class.” Nepal follows the Nice Classification system, which divides trademarks into 45 different classes covering goods and services.

At this stage:

  • Your business activities are analyzed

  • The correct class (or multiple classes) is selected

  • All required documents are prepared and verified

If you choose the wrong class, your trademark may not be fully protected. For example, registering under the wrong category may allow competitors to use a similar name in your actual business area.

Once everything is ready, your trademark application is officially submitted to the Department of Industry.

This includes:

  • Application form

  • Trademark label (logo/name)

  • Supporting documents

  • Government fees

Your trademark is now formally recorded in the system and enters the legal registration process.

After submission, the Department of Industry carefully reviews your application.

They check:

  • Whether your trademark is unique and distinctive

  • Whether it conflicts with existing registered trademarks

  • Whether it violates legal provisions (e.g., public morality or national interest)

Possible outcomes:

  • Approved for publication

  • Request for clarification or correction

  • Rejection (if it does not meet requirements)

Many applications face delays at this stage due to minor errors or similarity issues. Proper preparation reduces this risk.

If your application passes the examination, it is published in the Industrial Property Bulletin.

This publication serves as a public notice that:

  • You are claiming ownership of the trademark

  • Others have the opportunity to review and respond

It ensures transparency and protects existing trademark holders from conflicts.

After publication, there is a 90-day window during which any individual or business can file an objection against your trademark.

Opposition may occur if someone believes:

  • Your trademark is similar to theirs

  • It may confuse customers

  • It affects their brand reputation

If no opposition is filed:
Your application moves forward smoothly.

If opposition is filed:
You must respond with proper justification and evidence. Professional support is highly recommended in such cases.

If no opposition is received—or if the opposition is resolved in your favor—the Department of Industry approves your application.

You will then receive an official Trademark Registration Certificate.

At this stage:

  • You gain full legal ownership

  • Your trademark is protected under Nepalese law

  • You can take legal action against infringement
